General Counsel

Organizational Synopsis:

Experience and Educational Requirements:

The General Counsel will be a highly talented and business-minded attorney with at least 7 years of progressive experience and concentration in healthcare law with a strong knowledge of state and federal laws and regulations impacting health care systems to include OIG and CIA compliance matters that may come from a variety of healthcare environments including not-for-profit, for-profit, large hospital/health system, or a large national law firm. Previous experience or exposure working within a public healthcare environment/entity is preferred.

The General Counsel position will report to the North Broward Hospital District Board of Commissioners and administratively to the President/CEO.

Member of the Florida Bar.

Essential Responsibilities:

The successful candidate will possess extensive knowledge and experience in the following substantive areas of law and practice: corporate (for-profit and not-for-profit), Federal and Florida health laws, Medicare/Medicaid regulation, fraud and abuse (including anti-kickback laws and regulations), Stark, fee-splitting, EMTALA, corporate compliance, HIPAA administrative simplification (including privacy and security), hospital and physician daily operational issues, clinical trials and IRB, bioethics, patient rights and informed consent, medical staff matters (including, credentialing, bylaws, and disputes), false claims and qui tam actions (including investigations), self-disclosure and exclusions, billing and reimbursement issues, physician/hospital and other joint ventures, complex contract drafting and negotiation (hospital, physician and ancillary health care providers/suppliers – including group purchasing organizations), managed care contracting and negotiation.

The General Counsel will be energetic, motivated, and passionate about making a real difference and impact on healthcare service delivery at Broward Health and committed to advancing the mission of public healthcare. Candidate will possess excellent written and verbal communication skills to clearly articulate complex content to diverse stakeholders and effectively communicate the organization’s messages.

 

Additional desired candidate experience includes:

 

  • Proven leadership track record for management of a legal department to include establishing or maintaining systems, processes, policies and procedures.
  • Managing a business model which appropriately balances in house and outsourced legal services to ensure appropriate use of resources and cost effectiveness.
  • Strong board management and relationship building skills.
  • Outstanding diplomatic and interpersonal skills. Must be a consensus and team builder.
  • Ability to develop, mentor, motivate, and empower staff to advance goals.
  • Strong customer service orientation, responsiveness and accessibility by Broward Health executive leadership requiring legal services.
  • A personal style that builds relationships based on team play, trust, honesty, reliability, openness and confidence.
